End-User License Agreement (EULA) of TheBuckNetwork

This End-User License Agreement ("EULA") is a legal agreement between you and FallenDev Gaming LLC. Our EULA was originally created by EULA Template and has been customized for our Services.

This EULA agreement governs your acquisition and use of all applications or software ("Software") hosted directly from TheBuckNetwork and/or directly/indirectly from FallenDev Gaming LLC.

Please read this EULA agreement carefully before downloading or installing applications from TheBuckNetwork. It provides a license to use TheBuckNetwork applications/software and contains warranty information and liability disclaimers.

By using this site or any of the TheBuckNetwork software, this EULA agreement will be in effect. By clicking a download, installing, or visiting this site, you confirm your acceptance of the Software and agree to be bound by the terms of this EULA agreement.

If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not download, install, or use the Software.

This EULA agreement applies to any Software supplied by FallenDev Gaming LLC, including any updates, supplements, and support services for the Software unless other terms accompany those items on delivery.

License Grant

FallenDev Gaming LLC grants you a limited, personal, non-transferable, non-exclusive, non-sublicensable license to install and use the TheBuckNetwork software on devices you control, solely for your personal, non-commercial use and in accordance with this EULA.

You may load the TheBuckNetwork software on your device(s) (e.g., PC, laptop, mobile, or tablet). You are responsible for ensuring your device meets the minimum requirements of the software.

You are not permitted to: (Software originally created by: FallenDev Gaming LLC)

• Use the Software in any way which breaches any applicable local, state, federal, or international law;
• Use the Software for any purpose that FallenDev Gaming LLC considers a breach of this EULA;
• Harm, disrupt, or interfere with the operations of other organizations, such as Kru Interactive or Nexon Inc.;
• Bypass or attempt to circumvent security or access controls.

You are not permitted to: (Software originally created by: Nexon Korea Corporation & Kru Interactive Games)

• Edit, alter, modify, adapt, translate, or otherwise change the whole or any part of the Software; nor permit any part of the Software to be combined with or become incorporated in other software; nor decompile, disassemble, or reverse-engineer the Software (except to the extent such restriction is prohibited by law);
• Reproduce, copy, distribute, resell, or otherwise use the Software for any commercial purpose;
• Allow any third party to use the Software on behalf of or for the benefit of any third party;
• Use the Software in any way which breaches any applicable local, national, or international law;
• Use the Software for any purpose that Nexon Korea Corporation & Kru Interactive Games consider a breach of their EULA/terms.

Use of Legacy or Third-Party Game Clients

The Software may incorporate, interoperate with, or depend upon certain legacy or modified client components originally developed and owned by Nexon Korea Corporation and Kru Interactive Games. All such original content, assets, and intellectual property remain exclusively the property of their respective owners.

FallenDev Gaming LLC makes no claim of ownership over any such third-party materials. Our modifications, enhancements, and additional code constitute derivative or transformative works made available solely for educational, archival, or non-commercial purposes under the principles of Fair Use (17 U.S.C. § 107) and similar doctrines recognized in the United States.

By installing or using the Software, you acknowledge that you are not receiving, and that FallenDev Gaming LLC does not grant, any license, title, or rights to any original Kru Interactive or Nexon Korea intellectual property. All rights in those works are reserved by their respective owners.

Intellectual Property and Ownership

Nexon Korea Corporation shall at all times retain ownership of any Software that was originally created and owned by them. The Software (and all intellectual property rights, including any modifications) are and shall remain the property of Nexon Korea Corporation. See: Nexon Korea Privacy, Nexon Korea Terms of Use.

Kru Interactive Games shall at all times retain ownership of any Software that was originally created and owned by them. The Software (and all intellectual property rights, including any modifications) are and shall remain the property of Kru Interactive Games. See: Kru Interactive Privacy/Terms.

FallenDev Gaming LLC shall at all times retain ownership of the Software as originally downloaded by you and all subsequent downloads of the Software by you. The Software (and all intellectual property rights, including any modifications) are and shall remain the property of FallenDev Gaming LLC.

FallenDev Gaming LLC reserves the right to grant licenses to use its own Software to third parties.

Age & Lawful Use

You affirm that you are at least 18 years old and have the legal capacity to accept this EULA. You are solely responsible for ensuring your access and use comply with all laws and regulations applicable to you. We do not offer gambling or wagering. If your jurisdiction prohibits access to features that could be construed as “gaming,” you must not use those features.

Updates & Changes

We may provide updates or patches which may be required to continue using the Software or Services. Continued use after an update constitutes acceptance of the updated EULA.

Informational Content; No Financial, Investment, or Trading Advice

The Services may include educational and informational material, articles, tools, calculators, models, charts, estimates, and figures, including material relating to digital assets, cryptocurrencies, tokens, blockchains, and the XRP Ledger (collectively, "Informational Content"). All Informational Content is provided for general informational and educational purposes only.

Nothing on the Services constitutes financial, investment, tax, legal, accounting, brokerage, or trading advice, and nothing is a recommendation, endorsement, offer, or solicitation to buy, sell, hold, or transact in any asset, security, token, commodity, or financial product. FallenDev Gaming LLC is not a broker-dealer, investment adviser, financial planner, exchange, or money services business, and does not provide any such services.

Any prices, valuations, "implied" values, market caps, ranges, projections, scenarios, or models presented on the Services, including within any XRP-related page, tool, or calculator, are hypothetical, simplified illustrations based on assumptions that you select or that we choose for example purposes only. They are not forecasts, guarantees, or predictions of any actual or future price, value, or outcome. Past, simulated, or hypothetical performance is not indicative of future results.

Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless FallenDev Gaming LLC and its members, officers, employees, contractors, and licensors from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use or misuse of the Services or any Informational Content, your reliance on any Informational Content, your violation of this EULA, or your violation of any law or the rights of any third party.

Disclaimer of Warranties

THE SOFTWARE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FallenDev Gaming LLC AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE OR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, AND WE FURTHER DISCLAIM ALL WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY INFORMATIONAL CONTENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FallenDev Gaming LLC OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE GOODS/SERVICES) ARISING OUT OF OR RELATED TO THIS EULA, ANY INFORMATIONAL CONTENT, OR YOUR USE OF OR RELIANCE ON THE SOFTWARE OR SERVICES, HOWEVER CAUSED, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FallenDev Gaming LLC’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SOFTWARE/SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID (IF ANY) FOR THE SOFTWARE IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; SOME LIMITS MAY NOT APPLY TO YOU.

Export & Sanctions

You must comply with U.S. export control and economic sanctions laws. You represent you are not located in, under control of, or a national/resident of any country or entity subject to comprehensive U.S. embargoes or sanctions.

Termination

This EULA agreement is effective from the date you first visit the site or use the Software and shall continue until terminated. You may terminate it at any time by deleting or uninstalling all remnants of downloaded software.

It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the Software. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.

Governing Law & Venue

This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania and the federal laws of the United States of America, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Erie County, Pennsylvania.

Severability & Survival

If any provision of this EULA agreement is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect. The disclaimers, limitations of liability, assumption-of-risk, and indemnification provisions are essential elements of the agreement between you and FallenDev Gaming LLC and survive any termination of this EULA. This EULA, together with our Privacy Policy, constitutes the entire agreement between you and FallenDev Gaming LLC regarding the Services and supersedes any prior agreements on the same subject.

Your privacy is important to us. It is our obligation to respect your privacy and comply with any applicable law and regulation regarding any personal information we may collect about you, including across our website, https://www.thebucknetwork.com/, and other sites we own and operate.
